General Terms — apply to every booking.
Wedding Transport – Additional Terms & Conditions — apply in addition to the General Terms for wedding transport bookings.
School Transport – Additional Terms & Conditions — apply in addition to the General Terms for school transport bookings.
Cruisin’ With Kylie – Terms & Conditions
General Terms
1. Bookings & Deposits
- A 25% deposit is required at the time of booking to secure your date.
- Bookings are confirmed once the deposit has been received.
- The remaining balance is due 14 days prior to travel, unless otherwise agreed in writing.
- Quotes are valid for 14 days unless stated otherwise.
2. Payments
- Payments may be made via bank transfer or approved payment methods listed on your invoice.
- All prices include GST unless stated otherwise.
- Additional costs such as food, drinks, venue entry fees, tasting fees, or personal purchases are not included in the quoted price.
- Any changes requested after booking may result in additional charges.
3. Cancellations & Refunds
- 14 days or more before travel: Full refund of any payments made.
- 7–13 days before travel: 50% refund of the total booking amount.
- 0–6 days before travel: No refund available.
- If Cruisin’ With Kylie PL has paid non-refundable venue deposits or supplier fees, these amounts will be deducted from any refund.
- Transfers to another date may be offered at management’s discretion.
- If a customer chooses to cancel due to personal reasons, standard cancellation fees apply.
4. Changes to Itinerary
- Itineraries may be adjusted due to weather, road conditions, venue availability, or operational requirements.
- If a venue becomes unavailable, a suitable alternative will be arranged where possible.
- Timing may vary depending on traffic, roadworks, or unforeseen delays.
5. Passenger Responsibility & Conduct
- Passengers must follow all safety instructions provided by the driver.
- Cruisin’ With Kylie PL reserves the right to refuse service to any passenger behaving in a manner that is unsafe, disruptive, or intoxicated.
- Damage to the vehicle caused by passengers may result in additional charges.
- Children must be supervised at all times.
6. Alcohol Policy
- Alcohol may be consumed on board only where permitted by Victorian regulations and at the discretion of the driver.
- Excessive intoxication may result in removal from the vehicle or termination of the charter without refund.
7. Delays & Unexpected Events
- While every effort is made to run on time, Cruisin’ With Kylie PL is not responsible for delays caused by traffic, road closures, weather, or circumstances outside our control.
- If a tour or charter cannot proceed due to extreme conditions, an alternative date or partial refund may be offered at management’s discretion.
8. Force Majeure (Events Outside Our Control)
A Force Majeure event is an unforeseeable situation beyond the control of Cruisin’ With Kylie PL or the hirer. These events may disrupt or prevent travel from proceeding safely or as planned. Examples include:
- Natural disasters (flood, fire, storm, earthquake, bushfire, severe weather)
- Public health emergencies, epidemics, or government-issued restrictions
- War, civil unrest, political instability, or acts of terrorism
- Industrial disputes or major transport interruptions
- Road closures, police operations, or significant traffic incidents
- Any other event that could not reasonably be predicted or avoided.
If a Force Majeure event occurs:
- Cruisin’ With Kylie PL may cancel, postpone, or modify the trip if safety or operational requirements make it necessary.
- We will make reasonable efforts to offer an alternative date, adjusted itinerary, or credit, depending on the circumstances.
- Refunds may be offered minus unrecoverable costs already paid to suppliers (such as accommodation, venue fees, or third-party bookings).
- Force Majeure events do not constitute a breach of contract by Cruisin’ With Kylie PL.
- If a traveller chooses to withdraw from a trip that is still deemed safe to operate, standard cancellation fees apply.
9. Travel Insurance
- Guests are strongly encouraged to obtain travel insurance.
- Many insurers offer limited cover for natural disasters or severe weather, but may exclude war, political unrest, or terrorism.
- Please check your insurer’s Product Disclosure Statement (PDS) carefully.
10. Liability
- Cruisin’ With Kylie PL is not liable for loss, damage, injury, or inconvenience caused by third-party suppliers, venues, or Force Majeure events.
- Personal belongings remain the responsibility of passengers at all times.
- Cruisin’ With Kylie PL is not responsible for missed connections, bookings, or onward travel arrangements.
11. Acceptance of Terms
By making a booking with Cruisin’ With Kylie PL, you acknowledge and accept these Terms & Conditions.
Wedding Transport – Additional Terms & Conditions
1. Booking Confirmation
- Wedding transport bookings require a 25% non-refundable deposit due to high-demand dates and advance scheduling.
- Final numbers, run sheets, and pickup/drop-off locations must be confirmed 7 days prior to the wedding.
2. Wedding-Day Schedule & Delays
- Wedding transport operates on a strict timeline. Delays caused by guests, photography, speeches, or venue overruns may result in adjusted routes or reduced stops.
- If guests are not present at the scheduled pickup time, the driver may depart after a 10-minute grace period to maintain the run schedule.
3. Guest Behaviour & Safety
- Excessive intoxication, unsafe behaviour, or aggression may result in refusal of service or removal from the vehicle.
- Any damage caused by wedding guests will be charged to the hirer.
- The hirer is responsible for ensuring guests board the correct bus at the correct time.
4. Alcohol & Food on Board
- Alcohol consumption is permitted only at the driver’s discretion and must comply with Victorian regulations.
- Red wine, sparkling wine, and messy foods may be restricted to protect vehicle interiors.
- No open glass bottles are permitted unless otherwise approved.
5. Multiple Runs & Late-Night Pickups
- Wedding transport often involves multiple runs, including midnight or late-night pickups.
- All late-night runs must be pre-booked. Additional unscheduled pickups may not be possible due to fatigue management and legal driving hours.
- If guests are missing at the time of pickup, the bus may return for a second run only if pre-arranged.
6. Weather, Road Conditions & Venue Access
- Some wedding venues (e.g., Bear Gully, rural properties, private farms) may have limited access due to weather or road conditions.
- If access becomes unsafe, alternative pickup points will be arranged.
- Cruisin’ With Kylie PL is not responsible for venue-imposed access restrictions.
7. Force Majeure (Wedding-Specific)
If a Force Majeure event disrupts wedding transport (extreme weather, road closures, bushfire activity, police operations, etc.):
- We will make all reasonable efforts to provide alternative routing or timing.
- If the event prevents safe operation, the booking may be postponed or partially refunded minus unrecoverable costs.
- If the wedding proceeds but a guest chooses not to travel due to personal concerns, standard cancellation fees apply.
8. Liability & Guest Property
- Cruisin’ With Kylie PL is not responsible for lost items, including phones, jackets, bouquets, or personal belongings left on the bus.
- The hirer must ensure guests collect all items before disembarking.
9. Acceptance of Wedding Transport Terms
By booking wedding transport with Cruisin’ With Kylie PL, the hirer acknowledges and accepts these additional Wedding Terms & Conditions.
School Transport – Additional Terms & Conditions
1. Booking Requirements
- Schools must provide a confirmed booking request including date, times, pickup/drop-off locations, and student numbers.
- A finalised run sheet must be supplied 48 hours prior to travel.
- Any changes within 24 hours may not be guaranteed due to scheduling and legal driving hours.
2. Supervision & Duty of Care
- Teachers and school staff are responsible for supervising students at all times.
- A minimum of one supervising staff member must travel on the bus for all school bookings.
- Staff must ensure students board and exit the vehicle safely and follow driver instructions.
3. Student Behaviour
- Students must remain seated while the vehicle is moving.
- No standing, climbing, shouting, throwing objects, or behaviour that distracts the driver.
- If behaviour becomes unsafe, the driver may stop the vehicle until the situation is resolved.
4. Seatbelts & Safety Equipment
- All students and staff must wear seatbelts where fitted.
- Bags, sports equipment, musical instruments, or other items must be stored safely and must not block aisles or exits.
- The driver may refuse unsafe loads or items.
5. Timing & Delays
- Cruisin’ With Kylie PL will make every effort to run on schedule.
- Delays caused by traffic, roadworks, weather, or unforeseen events may affect arrival times.
- Schools should allow reasonable buffer time for excursions, carnivals, and inter-school sport.
6. Weather & Access
- Some rural or unsealed roads may become inaccessible during wet weather.
- If access is unsafe, alternative pickup points will be arranged with the school.
- The driver has final discretion regarding road safety.
7. Cancellations & Changes
- More than 48 hours notice: No cancellation fee.
- 24–48 hours notice: 50% of the booking fee.
- Less than 24 hours notice: Full booking fee applies.
- If a school event is postponed due to weather or operational issues, the booking may be transferred to another date subject to availability.
8. Medical & Emergency Situations
- Schools must ensure students with medical conditions have appropriate supervision and medication available.
- In an emergency, the driver will follow instructions from school staff and emergency services.
- Cruisin’ With Kylie PL is not responsible for administering medication.
9. Lost Property
- Schools are responsible for checking the bus for student belongings before disembarking.
- Cruisin’ With Kylie PL is not liable for lost items but will assist where possible.
10. Force Majeure (School-Specific)
If a Force Majeure event occurs (extreme weather, road closures, bushfire activity, police operations, etc.):
- The trip may be cancelled, postponed, or modified for safety reasons.
- We will make reasonable efforts to reschedule or adjust the itinerary.
- Refunds may be offered minus unrecoverable costs already paid to third-party suppliers.
- If the school chooses to cancel while the trip is still safe to operate, standard cancellation fees apply.
11. Acceptance of School Transport Terms
By booking school transport with Cruisin’ With Kylie PL, the hirer acknowledges and accepts these School Transport Terms & Conditions.
